Terms of Service

These Terms of Service ("Terms") govern your use of PixelJS, the browser-game portal at pixeljs.com, including creator channels and other subdomains such as app.pixeljs.com and play.pixeljs.com (together, the "Service"). In these Terms, "PixelJS," "we," "us," and "our" mean the operator of the Service, and "you" means anyone who uses it.

Please read these Terms carefully. They include a disclaimer of warranties and a limit on our liability.

1. Accepting these Terms

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The following policies are part of these Terms:

  • Content Policy: what may be published on PixelJS and how we enforce our rules.
  • Copyright Policy: how we handle copyright notices, counter-notices, and repeat infringers.
  • Creator Terms: additional terms for creators who publish games.

Our Privacy Policy explains how we collect, use, and share information when you use the Service.

2. The beta

PixelJS is in public beta. During the beta:

  • games are free to play;
  • players do not have accounts, and there are no comments, chat, purchases, or advertising; and
  • creator accounts are available by invitation only.

Because the Service is in beta, features may change, be added, or be removed, and the Service may sometimes be interrupted or unavailable. If we introduce advertising or purchases, we will update these Terms and our policies before those features launch.

3. Who may use PixelJS

PixelJS is operated from the United States and is intended for a general audience.

  • Players. Players of any age may play the general-audience games on PixelJS. Each game carries an age rating of Everyone, Everyone 10+, or Teen (13+) to help players and families choose.
  • Minors. If you are under 18, you may use the Service only with the permission of a parent or legal guardian. Children under 13 should use the Service together with a parent or guardian.
  • Creators. You must be at least 18 years old to have a creator account. During the beta, creator accounts are by invitation only.

If you are a parent or guardian and allow a minor to use the Service, you accept these Terms on the minor's behalf and are responsible for the minor's use of the Service. You may not use the Service where the law prohibits it, and if you use it from outside the United States, you are responsible for following your local laws.

4. Playing games

Games on PixelJS are made and published by creators, who are responsible for their games. Subject to these Terms, you may access and play games through the Service for your personal, non-commercial use. This does not give you ownership of any game or the right to copy, modify, or redistribute it, except as its creator allows or the law permits.

Creators choose each game's age rating, and PixelJS staff check it during review. Still, no rating can predict what every player will find appropriate, so parents and guardians should decide which games are right for their children.

Games run in an isolated sandbox in your browser and may not work on every browser or device.

5. Creator accounts

Creators sign in at app.pixeljs.com with an email address and password. If you have a creator account, you agree to:

  • give accurate information and keep it up to date;
  • keep your password confidential;
  • take responsibility for all activity under your account; and
  • tell us promptly through our contact page if you believe someone has accessed your account without permission.

Publishing on PixelJS is also governed by the Creator Terms, which include the license you give us to host and show your games and your responsibility for claims arising from your content.

6. Acceptable use

When using the Service, you agree not to:

  • break the law or violate anyone's rights;
  • publish, share, or link to anything that violates the Content Policy;
  • attempt to escape the game sandbox, or to access accounts, systems, or data that are not yours;
  • interfere with or disrupt the Service, its servers, or its networks, or bypass any security measure or technical limit;
  • use bots, scrapers, or other automated tools to access the Service in a way that places an unreasonable load on it;
  • fake or inflate play counts, or otherwise manipulate statistics;
  • impersonate any person or organization, including PixelJS staff, or misrepresent your affiliation with anyone;
  • submit false, misleading, or abusive reports, appeals, or copyright notices; or
  • copy, sell, or commercially exploit any part of the Service without our permission, except as the law or an applicable license allows.

If you believe you have found a security vulnerability, please report it through our contact page, which is also listed in our security.txt file. Do not exploit the vulnerability, access data that is not yours, or disrupt the Service.

7. Content on PixelJS

No adult content. PixelJS does not allow pornography, nudity, or sexual or sexually suggestive content, and it has zero tolerance for sexual content involving minors. The Content Policy explains these and our other rules.

Review. PixelJS staff review every new game version and every listing change before it is published. Review helps us enforce our policies, but it is not an endorsement, and it cannot guarantee that a game is accurate, error-free, or suitable for every player.

Removal. We may remove content or restrict access to it at any time, including if we believe it violates these Terms, our policies, or the law, or if it could harm players, creators, or the Service.

Reporting. To report a game, use the Report button on the game's page. For anything else, use our contact page. To report copyright infringement, use our copyright notice form.

Other websites. Channels and listings may link to websites we do not control. We are not responsible for those websites, and your use of them is governed by their own terms and policies.

8. Our intellectual property

The Service, including its software, design, text, and graphics, and the PixelJS name and logos belong to PixelJS or its licensors and are protected by intellectual property laws. These Terms do not give you any right to use our name, logos, or other trademarks, except as the law allows.

The PixelJS engine is open-source software. Its open-source license, not these Terms, governs your use of the engine; see the engine's site for details.

If you send us feedback or suggestions, we may use them without any obligation to you.

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act and, in appropriate circumstances, terminate the accounts of repeat infringers. See our Copyright Policy.

Our Privacy Policy describes how we handle information, including how we protect children's privacy.

10. Suspension and termination

You may stop using the Service at any time. Creators may close their accounts as described in the Creator Terms.

We may suspend or end your access to all or part of the Service at any time, with or without notice, if we believe you have violated these Terms or our policies, if the law requires it, or to protect players, creators, or the Service. We may also change, suspend, or discontinue the Service, or any part of it, at any time.

Provisions that by their nature should survive termination will survive, including those on intellectual property, disclaimers, limitation of liability, and governing law.

11. Disclaimer of warranties

The Service, and all games and other content on it, are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, PixelJS disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not promise that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any game or other content is accurate, safe, or appropriate for you. Games are provided by their creators, and PixelJS makes no promises about them.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, PixelJS and its owners, staff, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to the Service or these Terms, even if we were told such damages were possible.

Because the Service is free, our total liability for all claims arising out of or relating to the Service or these Terms is limited to US$50.

These limits apply under any theory of liability, including contract, tort (including negligence), and statute. They do not limit any liability that cannot be limited under applicable law. Some jurisdictions do not allow these limits, so they may not fully apply to you.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page with a new effective date and give notice on the site. Changes take effect when posted unless the notice says otherwise. If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree, stop using the Service.

14. Governing law

These Terms are governed by the laws of the United States and the applicable laws of the U.S. state in which the operator of PixelJS is established, without regard to conflict-of-law rules.

15. General

  • Entire agreement. These Terms, together with the policies listed in Section 1, are the entire agreement between you and PixelJS about the Service and replace any earlier agreements on the same subject.
  • Severability. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will stay in effect.
  • No waiver. If we do not enforce a provision, we do not give up our right to enforce it later.
  • Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example as part of a merger, acquisition, or sale of assets.
